I. General Terms & Conditions of Trade

1. Quotation Validity
Our quotations remain valid for 30 days from the date of issuance, unless otherwise specified.

2. Payment Terms
For custom or special-order items, a 50% deposit is required upon acceptance of the quotation. By paying the deposit, the Purchaser agrees to all terms and conditions outlined by Natural Surfaces. Full payment is required before goods are released or installation begins. Ownership of the goods remains with Natural Surfaces until full payment is received.

3. Shipping and Delivery
For imported goods, a shipment lead time of approximately 20 weeks is expected, subject to product availability and logistics. Special orders, custom production, large-scale commercial orders, or small quantities may require additional time for fulfillment.

4. Product Quantities
Orders are rounded to the nearest box lot, which may result in minor variations between the quantity ordered and the amount delivered. Natural Surfaces reserves the right to adjust pricing accordingly. Any provided product estimates are offered as a free service, but the Purchaser assumes responsibility for the quantity ordered. We accept no liability for miscalculations, shortages, or surpluses.

5. Delivery and Storage
The price of imported goods includes delivery to our storage facility in Auckland. It is the Purchaser’s responsibility to collect their order from this location. Delivery to a specified location can be arranged at an additional cost. We offer free storage for up to four weeks from the agreed arrival date. After this period, storage charges will apply at the prevailing commercial rate.

6. Overdue Payments
Final payment is required within two weeks of the agreed arrival date.

7. Force Majeure (Events Beyond Our Control)
We are not liable for delays or failures caused by events beyond our control (Force Majeure). These events include, but are not limited to, strikes, natural disasters, transportation disruptions, and government restrictions. In such cases, our obligations are suspended, and we will make reasonable efforts to resolve the situation.

8. Intellectual Property
All product names, logos, marketing materials, designs, drawings, and renderings are the property of Natural Surfaces or their respective owners. Reproduction or distribution without written consent is prohibited.

9. Insurance
Natural Surfaces holds insurance coverage for Marine Cargo, Material Damage, and Public Liability.

10. Consumer Guarantees Act
Guarantees under the Consumer Guarantees Act 1993 are excluded when goods are acquired for business purposes in accordance with Sections 2 and 43 of the Act.

Natural Surfaces reserves the right to modify these Terms and Conditions without prior notice.


II. Terms & Conditions of Installation Works

1. Installation Quotes
Our installation quotes are based on the provided architectural plans and preliminary discussions. Any changes to the scope or quantity of work during the project may result in an adjusted quotation.

2. Booking the Installation Team
To secure an installation date, a 10% deposit of the quoted installation cost is required. If special materials are needed, an additional deposit may be requested to ensure availability.

3. Progress Payments
Payments for installation work must be made according to the agreed schedule. Work may be suspended if payments are overdue.

4. Delayed Construction Sites
If a construction site is delayed, we reserve the right to reschedule the installation. Any costs related to material storage or expiration due to delays are the customer’s responsibility.

5. Product Estimation
We can provide a free estimate of required materials, including waste. However, the Purchaser is responsible for ordering the correct amount. Any shortage of materials may affect the quoted price.

6. Vertical Transport
The quote does not include costs for vertical transport (e.g., cranes). These services must be arranged separately.

7. Material Handling
Materials supplied by others must be stored on-site in an accessible location. Additional handling charges will apply if required.

8. Substrate Preparation
Substrate preparation is not included in the quote. Floors and walls should be prepared according to New Zealand standards. Additional costs for preparation will be quoted separately.

9. Access Solutions
Scaffolding or other access solutions must be provided by the general contractor.

10. Tile/Flooring Protection
Installation protection for tiles or flooring is not included. If required, this will be quoted separately.

11. Waste Management
If the general contractor does not provide waste management, additional charges for waste removal will apply.


III. Returns Policy

1. Non-Returnable Items
Custom orders, sale, clearance, or promotional items are non-returnable unless faulty or incorrectly supplied. Imported goods requested by the Purchaser are also non-returnable.

2. Surplus Materials
We do not accept returns on surplus tiles. We recommend ordering 10-20% extra to account for breakages and future repairs, as exact matching batches may not be available later.

3. Damage Claims
Any damage or irregularities must be reported at the time of delivery. Claims for goods signed as received in good condition will not be accepted.

4. Incorrect Deliveries
Any incorrect quantities or product types must be reported within 48 hours. We may request photographs and will arrange the collection of any items sent in error.

5. Product Variations
Due to the natural materials and manufacturing processes, there may be variations in shade, size, and grain pattern between samples and delivered goods. These are not considered defects, and claims will not be accepted on these grounds.

6. Installation Acceptance
Once installed, goods are considered accepted, and claims for incorrectly supplied or damaged goods will not be accepted.
